General statement and Definitions
Bushguide101 does not act as an agent, but as a marketing coordinator between the Participants and the Conductors of Adventure Workshops.
‘Adventure Workshops’ means any bushcraft courses, survival courses, survival trails, primitive trails, backpacking trails, guided Adventure Workshops, courses, workshops, skills developments, assessments, specialized trainings, team buildings tours, transfers, or any other Adventure Workshops, which Bushguide101 is offering on its website.
‘Conductors’ are independent companies, which are offering their Adventure Workshops on their own terms and conditions at Bushguide101 website. They are the Adventure Workshop providers and conductors. Bushguide101 is not responsible for the quality or content of the Adventure Workshops and cannot be held accountable for that.
‘Entities’ means shareholders and directors of Bushguide101, their heirs, agents, employees, subcontractors, assistants, and any other person, whether as an employee, participant, spectator or in any manner whatsoever.
‘Instructors’ are persons either employed, self-employed or voluntarily conducting Adventure Workshops for the Conductors as trainers, mentors, subcontractors, assistants, or in any manner whatsoever.
‘Participants’ are persons who booked Adventure Workshops at the Bushguide101.com website.
1. Participant’s Requirements
1.1 Enrollment for Adventure Workshops is subject to availability and on a first-come, first-served basis.
1.2 Participants must follow all instructions given by the instructors and adhere to all safety guidelines.
1.3 The instructors reserve the right to modify the course schedule or content as needed.
1.4 Participants must respect the local environment and follow all laws and regulations.
1.5 Any disputes or complaints regarding the courses should be directed to the company that is conducting them (‘Conductors’).
1.6 The terms and conditions of the Conductors will also apply to the Participants, and that the Participants must agree to those terms and conditions in order to enroll in the courses.
1.7 Participants are liable to complete and sign a “Client Profile”, “Indemnity and Waiver of Liability Form” and a “Terms and Conditions” form where applicable.
1.8 Bushguide101 “Terms and Conditions” are applicable to all bookings whether they have been signed for or not.
1.9 Medical and Travel insurance is excluded in all rates and is compulsory to all Participants.
1.10 Participants are responsible for his/her own travel arrangements pre and post Adventure Workshop.
1.11 Bushguide101 Co. shall not be liable for any loss or damage to the Participant’s personal possessions.
1.13 Bushguide101 has the right to refuse to offer a service to anyone for any reason.
1.14 The Participant confirms that all the information and records provided to Bushguide101 are accurate and honest.
1.15 The Participant will provide Bushguide101 with a clear indication of the Participant’s medical health status. The Participant must be physically fit and able to participate in the Adventure Workshops.
1.16 Bushguide101 reserves the right to request that the Participant provides a doctor’s certificate authenticating that he/she is physically and emotionally fit and able to undertake the Adventure Workshop.
1.17 The Participant acknowledges and agrees that Bushguide101has the right to use any photographs and/or videos provided to it by the Participant or taken by Bushguide101 representatives or Conductors, for promotional purposes.
1.18 The Participant understands that certain risks may arise whilst travelling or residing in remote areas and due to the nature of the Adventure Workshops; The Participant hereby declares that he/she understands that these dangers are characteristic of the Adventure Workshop; states that his/her participation is completely voluntary; and accepts all risks associated with the Adventure Workshop.
1.19 The Participant understands that all Adventure Workshops have a minimum age restriction of 16 years and a maximum age restriction of 65 years on them, unless otherwise decided upon at the sole discretion of Bushguide101.
1.20 The Participant hereby indemnifies Bushguide101 and all its Representatives, Conductors, Instructors and Partners harmless against any and all legal claims, expenses, damages, and liabilities, which may arise during or after the Adventure Workshop.
2. Expulsion
If a Participant, after being warned, persists in disturbing the other participants or Adventure Workshop procedures, both, Bushguide101 and the Conductor can end their Adventure Workshop at any time with no refund owing to that person. Bushguide101 or the Conductor will not be held responsible for any additional costs incurred by the Participant as a result of expulsion.
3. Payments and Confirmation of Bookings
3.1 Rates are quoted in Euros.
3.2 Tariffs are subject to alterations without prior notification.
3.3 In case payments are settled via bank transfer, all international bank charges are for the client’s own account.
3.4 Payments made into the incorrect bank account is for the client’s own responsibility and all fees applicable to correct this, are for the clients own account.
4. Cancellation Policy
4.1 Withdrawals of Participants from a booking must be done in writing and emailed to Bushguide101 immediately.
4.2 If a cancellation is made before or any time up until 3 months before the Adventure Workshop start date the Participant will be entitled to receive a full refund of the paid amount to Bushguide101.
4.3 If cancellation is made between 3 months and 3 weeks before the Adventure Workshop start date, the Participant shall be entitled to receive a 50% refund of the paid amount to Bushguide101.
4.4 If cancellation is made within 3 weeks before the Adventure Workshop start date, the Participant shall not be entitled to any refund of any monies paid. Any monies still outstanding by the Participant will still be due in full.
4.5 Should Bushguide101 replace a cancelled spot on an Adventure Workshop within good time, which is not guaranteed, and the new Participant has paid in full, the original Participant will be entitled to a refund of 50% of the Adventure Workshop price.
4.6 Should Bushguide101 see fit to provide a participant and/or group with a credit note due to a cancellation, the participant and/or group will be required to make use of the full value of the credit within 6 months from the date of the start of the original Adventure Workshop that was booked, subject to availability. Any credit note, or part thereof, not used within the 6-month period will be non-refundable.
4.8 Should the minimum numbers for an Adventure Workshop not be reached, Bushguide101 has the right to cancel an Adventure Workshop within good time and full refund will be given.
5. Amendments
5.1 Participant requests to transfer their bookings to different Adventure Workshops, and/or to make amendments to Adventure Workshop durations or dates, will not be permitted following the payment, except in exceptional circumstances; in which case an administration fee of EUR 80.- will be applicable.
5.2 In the event that Bushguide101 agrees to any such amendments, any payments that had already been deemed non-refundable, will remain so, regardless of the new dates.
5.3 In cases of unforeseen circumstances that Bushguide101 has no control over, and which causes the Adventure Workshop to be altered, Bushguide101 has the right to adjust the arrangements which best fits into the itinerary, even though confirmation of the Adventure Workshop has already been finalized and payments made.
5.4 Adjustments to the itinerary must be made available to the Participants immediately.
5.5 If a Participant has a request to make certain changes to the Adventure Workshop, such as different pick-up points, pick up times etc. it will only be considered if convenient to the other Participants. Any requests such as these, need to be made at least 30 days prior to the commencement of the Adventure Workshop, which shall be determined at the sole discretion of Bushguide101.
